
The Delhi Police have registered two more FIRs against a Kenyan diplomat’s son for allegedly molesting two students in his school, officials said on Wednesday. The diplomat’s son was earlier accused of allegedly sexually abusing a minor in a school bus.
“We have registered two more FIRs after two more complainants came forward alleging molestation against the same accused. The complainants are from the same school,” a police official said.
“We have written to the MEA (Ministry of External Affairs) requesting permission to arrest and interrogate the accused. A response is yet to be received,” the official added.
The diplomat’s son, a Class 12 student, was booked under Section 75(2) of the Bharatiya Nyaya Sanhita (BNS) and Section 10 (aggravated sexual assault) of the Protection of Children from Sexual Offences (POCSO) Act in September in the case involving the minor. He was later suspended by the school and is believed to be an adult.
In February, the MEA asked Kenya to revoke the immunity of the diplomat’s son so that he could be prosecuted for the alleged sexual assault of the minor girl on a school bus in August last year.
The investigation against the accused could not proceed due to the immunity that protects diplomats and their families from arrest or prosecution in a host country.
As per the 1961 Vienna Convention on Diplomatic Relations, the “immunity from the jurisdiction of diplomatic agents and of persons enjoying immunity” can only be waived by the sending country — in this case, Kenya.

The convention also states that family members of a diplomat who live with them and are not citizens of the host country receive the same immunity as the diplomat.
