Mira Bhayander developer ‘gets threat calls’: HC tells top cop to look into developer’s complaint over transactions related to ‘enemy property’

The Bombay High Court on Wednesday told the Mira Bhayander–Vasai Virar (MBVV) Police Commissioner to look into “serious allegations” in a complaint by a developer that he had received threat calls and messages from Pakistan-based mobile number in connection with “illegal transactions” related to “enemy property” in the area.

The petitioner, developer Raju Hamirmal Shah, approached the HC seeking registration of FIR on his complaint, stating that he had received threat calls and voice messages on his WhatsApp number made from a mobile number from Pakistan, as he had raised voice against the said transactions.

Enemy properties are the movable and immovable assets that were left behind in India by the individuals who migrated to the countries that are designated as “enemy nations” during the time of conflict

As per petitioner, he had been raising concerns over “illegal transactions” pertaining to plots in the area which are “enemy properties” under central government’s control.

He claimed the development had started on the said lands based on unauthorised permissions from the civic body and “fraud” has been committed on the government controlled properties.

The petitioner said as he raised voice against the same, he received the said threat calls and despite filing a complaint with Police, no FIR was registered in the matter, hence the plea.

Additional Public Prosecutor (APP) Prajakta P Shinde for the state government sought time to take instructions from concerned officials to respond to the plea.

“Is this how properties are being released? There are serious allegations. Speak to the Police Commissioner himself. We will keep the matter next week. How have these transactions taken place including the release deed etc? Start investigating,” the bench of Justices Revati Mohite-Dere and Neela K Gokhale orally remarked.

“Considering serious allegations made by the petitioner, we deem it appropriate to direct the APP to place this petition before Commissioner of Police to enable them to take appropriate steps,” the HC noted in the order and posted further hearing to April 16.
